Re: Zaira Lopez; week two 2014-2015 School Year.

Hello everyone,

Welcome to week two of the 2014-2015 school year. It is my hope you all are posting and noting your perspective as it relates to the topics of the week.  Friendly reminder blogs are due Sunday by midnight.  Have a great weekend!!!

On September 8, 2014 Renata Congleton, 27, drove drunk to Trinity Elementary School in Florida to pick up a child, however, staff reportedly noted she was extremely intoxicated. Hence, her blood-alcohol was more than five times the legal limit, registering at .413. So school officials did not allow the child to leave the premise with Renata so she fled crashing into two vehicles before the police reported to the scene.  When police were finally able to apprehend Renata she was at her residence sitting on the porch, it should be noted she resisted by kicking and scratching the deputies.

I would charge Renata with endangerment to a child and assault to a police officer because she tried to drive an elementary student home while she was drunk, and she kicked and scratched deputies. I believe that the children are secure in school because the staff did not let the student leave with the parent or guardian do to the fact that she was intoxicated and posed a danger to a small child.

    1. I strongly agree with Tony that Renata should be charged with assault. Not only was she drunk but did assault the deputies by kicking and scratching them. Like Tony said the child was much safer at school than going with her,she needs a better guardian.

I can only imagine how much alcohol the woman must have consumed for it to affect the way she was thinking that much. This woman is clearly not a responsible parent and I would also look toward getting child protective services involved.

    4. Isaiah, I agree that she should be cautious driving in a school zone while intoxicated but she should be charged and sent to jail. She did cause a car accident and was resisting the arrest which makes her case even more strong. I just believe she should get more than probation. One should always be cautious any time they are behind the wheel for their own safety, but when driving recklessly in a school zone not only are you endangering yourself.

    5. I disagree with Tony about charging her with child endangerment because the parent did not have the child with her while driving intoxicated. Maybe if the child was with her then yes of course I'll charge her with child endangerment . However I agree with Tony on charging the woman with assault to a police officer since she was scratching and kicking.

  2. I beleive that Reneta is in the wrong! FIrst off you cant drink and drive. IF your in school zone with children you have to be cautious. Her child should not b ein the car with her. SHe scrachted the police officer also she should get 2 years of probation.

In my opinion Isaiah I think she should get way more that 2 years of probation because she did put her child in danger , assault a police officer , drinking while intoxicated and caused a wreck. She should get at least 5-10 years in prison because she did brake a lot of laws in such a short period of time.

    I'll charge the women a class B felony for assault to a police officer. Also, another class B felony for endangering a child. the children were secure in school. The staff just save the children from a car accident. Hence, she was intoxicated. YBJ: five months in jail with no parole.

  6. I would charge Renata with Reckless Endangerment. She is obviously endagering herself & the other people around her by drinking & driving. The children in school are safe they prevented the child from being in the car accident with the mother when she sped off angry, she also kicked & scratched the officers, it could have been way worse and she could have tooken that out on her child, so i would charge her with assault on a officer also.

    I would charge Renata with reckless endangering because she is putting her self and other people life's in danger. She seems like she doesn't care if she is willing to put a little girl in her car while she is intoxicated. She should know better she Is already old enough to know from right to wrong. The little girl is safe because teachers took control of the situation. Renata should pay for the damage she did to the cars she hit .

    2. I completely agree with you Sarai. She is already a grown woman who should know what and what not to do. Unfortunately, Renata is not a very responsible mom; she has had no regards for anyone’s life, including her daughters. She seems incapable of looking after herself or her daughter.

  8. Renata should be charged with 1st degree felony for causing a car accident while intoxicated. Also she should be charged with Felony resisting for scratching and kicking the deputies, and charged with reckless endangerment for putting children and other adults in danger. She shouldn't pick up her daughter knowing that she's been drinking alcohol and risking innocent people's life.

    3. You are right Alejandra. In some cases I’d be cajoled to feel sympathy for mothers because I wouldn’t want to separate a mother from her child.   10. I would charge Renata with assault towards and officer and endangerment to a child. The reason I would charge her like this is because she kicked and scratched the officer while she was being arrested. The reason I would charge her with endangerment to a child is because she tried to pick up the child from school and drive with her in the vehicle.

In my own perspective i would charge Renata with the misdemeanor of reckless endangerment because she created a substantial risk of hurting others out on the road.I would also charge Renata with a DUI driving under the influence since she was more than 5 times the legal limit. She shouldn't be driving in the first place and going out to pick up a child. Also she clearly isn't thinking straight and doesn't know what she is doing. Somebody does not just drive drunk in a school zone,luckily the school officials did not let the child leave. If the child would have gone with Renata it would have been a much bigger incident. Renata may have a drinking problem which may have caused this.

  13. I think Renata should be charged with DUI, resisting arrest, reckless endangerment because what she did put many people in danger. The school did the right thing by not letting the child go with Renata as it could have put that child's life in danger. I think everyone involved was very lucky as Renata's blood alcohol level was 5 times the legal limit .

  14. I would charge Renata with endangerment of a child, DUI, and aggravate assault towards police officers. I feel this is a completely reasonable punishment for what she has done. Because by being overly intoxicated not only did she endanger her own life but the life of others, specifically the life of the child she was going to pick up, earning her a DUI charge and the endangerment of a child. By continuing her reckless behavior she earned an aggravated assault charge, when she began to fight police officials violently. It is obvious that Renata was not in a well state of mind when committing this acts, but she must face the consequences of her actions.

  15. Reneta should be charged by being heavily intoxicated, resisting arrest, assaulting officers and putting her child in danger. Being intoxicated while driving is a crime. She also did it during school hours putting other kids in danger. I agree with what the school did by keeping the child while police arrived. She should suffer the consequences of her reckless behavior that could have injured or killed others.

  16. I would charge Renata with child endangerment, DUI, assault, and resisting arrest. Although the child she was picking up at school did not get in the vehicle with her she still was intoxicated in an Elementary School, so anyone was in danger at the time Renata was in the vehicle. DUI of course she was intoxicated while driving with a level of .413 which was more than five times the legal limit. Assault and resisting arrest came into play when the police officers came to Renata's residence and tried to apprehend her. As we read the blog we were told that she kicked and scratched the officers this brings assault to the case and along with it resisting arrest. In my opinion she should get 25 years in prison with the possibility of parole.

    1. That seems like a reasonable amount of prison time. I would also like for her to take classes to deal with her alcohol issues after her prison sentence is over. It was also a good call on charging her with resisting arrest because most would over look that and just charge her with DUI, endangerment of a child and assault of a police officer.

  17. One should always be cautious when driving a vehicle and for no reason should anyone drive under the influence. Now to drive in a school zone while intoxicated is completely absurd. This woman in my opinion is incapable of caring for a child; it would only be outrageous to consider her a parent. This is why I strongly believe that not only should she be given time in prison for the charges of DWI, assaulting an officer, the endangerment of children in a school zone, reckless driving, and resisting arrest but she should also lose custody of the child to someone more responsible.

Any responsible mother knows not to endanger her child or the life of others by drinking and driving, especially in a school zone. In many states Renata could be charged with misdemeanor or felony resisting arrest. Hence, I would charge Renata Congleton with reckless driving, endangering a child, and resisting arrest.

I would charge Renata with Child Endangerment because she drove to an elementary school drunk, she could easily have killed a child or her own while trying to take her home. I would charge her with DWI, because she was driving while intoxicated. Last, I would charge Renata with Assault on a Police Officer because she resisted arrest by kicking and scratching deputies.

She was putting a lot of children in danger and herself as well. She also assaulted an officer by kicking and scratching while she was getting arrested. She wasnt just endangering her child but other peoples children. She also crashed into two cars so i would appoint some fines for the damages. And finally i would charge her with assault to a police officer because she resisted arrest.

  24. I would charge Renata with two to three years in jail. The reason for being a bit too easy on her is because she has children and it seems to me like she needs a lot of help for her alcohol problem. After she finishes her time in jail she should have an alcoholics anonymous class to help her with her addiction. I do agree she was at fault for all the things she did but when one is an addict there is no control.

  26. I would charged her with DUI, endangerment of a child, assault on a police officer, some fines for hitting two cars, and resisting arrest. DUI for driving while drunk, endangerment of a child because even though her child wasn't in the car she was at a elementary school which could have resulted in a huge mess. Resisting arrest and assault come in play when she was being apprehended, in all I would give her 30 years of prison with a chance of parole and for her to take alcoholic awareness classes while serving her prison sentence.

She should have given up, and she should've complied with the police officers instead of resisting arrest. Renata was also being a reckless driver, so she should be fined for the mess she has caused.

She could have put more children in danger than just the child she was going to pick up. She managed to assault a police officer. She was so drunk that she didn’t even know what was happening.   27. I believe that Renata should be charged with 3-4 years in jail. Not only was she driving under the influence but was endangering her child and the others in the school zone. She was driving recklessly while damaging 2 vehicles and resisting the arrest of an officer. Imagine what could've happened if she had left with her child and continued being intoxicated, the outcome would've been worse than it is originally.

  28. I believe that Renata should be charged with DUI and endangerment of a child. The reason for this is because she wanted to take her child while intoxicated. Renata was at a school and many kids were put at risk because she was drunk and was driving. She also hit two vehicles while going back home which she should be charged with reckless driving. Lastly, I would charge her for resisting arrest. The police officers tried to apprehend Renata, but she fought back unwilling to face her consequences.

  29. I believe Renata should be charged with DWI, reckless driving, and assault on a police officer. I would sentence her to 3 to 4 years minimum in jail because of her actions. However, she could be charged with endangerment to a child, I would not charge her due to the fact that she never had the child under her care.

  30. I would charge the women with endangerment to people and children. What was so emotional or stressing her out so bad that she had to drink that much? I would charge her with this because what if on her way to pick up her child she would've hit someone or hit a child while trying to pick up hers? I would also take her child away from her until she undergo rehabilitation classes for drinking. Then after she finishes that she would serve 6 months in jail for assault to an police officer.

She is not capable or responsible enough to be caring for her kid which is why I also believe she child should be removed from her custody. Thankfully the teachers were able to notice how intoxicated Renata was before taking the child.

Renata should also be charged with an assault to an officer for kicking and scratching. I am glad school officials kept her child safe, because anything could have happened to him/her.

Her alcohol level was too high for her to be behind the wheel which is why she should get charged with DWI. Renata was not cooperating with police during her arrest even then she could of injured a police while she was kicking and scratching. The police were in danger and were assaulted.

  34. I would charge Renata with child endangerment, assault to a police, and driving while intoxicated. Even though the child wasn’t with her she was still causing a huge danger to her child. If she would’ve picked her up who knows what would’ve happened to not only her but other innocent people who might have been driving during that time.   35. Renata should be charged with endangerment to children for recklessly driving intoxicated to a elementary school. No one in their right mind would something as ridiculous as this. Also, she should be charged with hit and run for damaging the two cars in the parking lot. Renata will also have to pay for the damages to the vehicles.   36. I would charge Renate with Child Endangerment, even if the child wasn't with her she was at an elementary school and DWI, for drinking and driving in a school zone. For hitting two cars, and endangering the other drivers she should pay fines or more charges. Also, I would charge Renata for kicking and scratching the officers as they we're about to arrest her. Renata could have taken better choices and decisions, so now she wouldn't facing long-term consequences. I believe that she's probably going through some hard times,but that's not an excuse for her reckless actions. Her child should be taken away from her. Although the child needs his mother, she's only providing a bad example. I would sanction her to two years in jail with parole for endangering the public, and for assaulting the officers. Furthermore, I would make her go to rehab for about a year, so she could receive her child back to her safe hands.

Also, driving to an elementary school while intoxicated was not a very smart choice, but then again, when do intoxicated people think? Renata tried to pick up the child in these conditions and I do thank the school for doing a fantastic job of not giving up the child to her and for noticing her actions and behavior. She should also be charged with endangerment to a child and a couple of months in rehab to control her intoxication. She was not only endangering her life but the life of her child as well.

The teachers had every right to keep the child with them. That's part if their job as a teacher to protect them from harm. They did their jobs correctly. Although she didn't drive her child home, she still managed to crash into 2 vehicles. Then, she scratched and kicked the police officer. I believe Renata should be charged with endangerment of a child, assault on an officer, and with DWI. In addition to that, Renata should be given help by going to alcoholic classes if this isn't the first DWI she has. Her child is obviously not safe with her, so the child should stay with her father or other legal guardian meanwhile Renata is being helped. She should do about 3 years in jail.
